  efinition of bill of exchange
  A bill of exchange is an unconditional order in writing, addressed 
by
  person to another, signed by the person giving it, 
requiring the
  on to whom it is addressed to pay on demand or at a 
fixed or
  rminable future time a sum certain in money to, or to the order
of, a
  ified person or to bearer.
  An instrument which does not comply with these conditions, or 
which
  rs any act to be done in addition to the payment of money, is 
not a
  of exchange.
  An order to pay out of a particular fund is not
  nditional within the meaning of this section; but an unqualified
order

  An inland bill is a bill which is or on the face of it purports
to be-

  drawn within the Colony, upon some person resident therein.
  Any other bill is a foreign bill.

  Where, in a bill, drawer and drawee are the same person, or where

bill of

  Where a bill contains words prohibiting transfer, or

  Where a bill, either originally or by

  The sum payable by a bill is a sum certain within the meaning of 
this
  nance, although it is required to be paid--
  with interest;
  by stated instalments;
  by stated instalments, with a provision that, upon default in 
payment

  according to an indicated rate of exchange or according to a rate 
of
  ange to be ascertained as directed by the bill.
  Where the sum payable is expressed in words and also in figures,

  Where a bill is expressed to be payable with
  rest, unless the instrument otherwise provides, interest runs
from the

  Bill payable on demand
  A bill is payable on demand--
  which is expressed to be payable on demand, or at sight, 
or on
  entation; or
  in which no time for payment is expressed.
  Where a bill is accepted or indorsed when it is overdue, it shall, 
as
  rds the acceptor who so accepts or any indorser who so indorses
it, be

  Bill payable at future time
  A bill is payable at a determinable future time within the meaning 
of
  Ordinance which is expressed to be payable--
  at a fixed period after date or sight;
  on or at a fixed period after the occurrence of a specified 
event
  h is certain to happen, though the time of happening may be
uncertain.
  An instrument expressed to be payable on a contingency is not a 
bill,
  the happening of the event does not cure the defect.

  Ante-dating and post-dating
  Where a bill or an acceptance or any indorsement on a bill is 
dated,
  date shall, unless the contrary is proved, be deemed to be the 
true
  of the drawing, acceptance, or indorsement, as the case may be.
  A bill is not invalid by reason only that it is ante-dated or 
post-
  d, or that it bears date on a Sunday or any other general holiday.

  Computation of time of payment
  e a bill is not payable on demand, the day on which it falls due 
is

  Referee in case of need
  drawer of a bill and any indorser may insert therein the name 
of a
  on to whom the holder may resort in case of need, that is to say,

  the bill is dishonoured by non-acceptance or non-payment. Such
person

  Optional stipulations by drawer or indorser
  drawer of a bill and any indorser may insert therein an

  Definition and requisites of acceptance
  The acceptance of a bill is the signification by the drawee of 
his
  nt to the order of the drawer.
  An acceptance is invalid unless it complies with the 
following
  itions, namely--
  it must be written on the bill and be signed by
  drawee. The mere signature of the drawee, without additional
words, is
  icient;
  it must not express that the drawee will perform his promise by 
any
  r means than the payment of money.

  Time for acceptance
  A bill may be accepted--
  before it has been signed by the drawer, or while 
otherwise
  mplete;
  when it is overdue, or after it has been dishonoured by a
  ious refusal to accept or by non-payment.
  When a bill payable after sight is dishonoured by non-acceptance, 
and
  drawee subsequently accepts it, the holder, in the absence 
of any
  erent agreement, is entitled to have the bill accepted as of the 
date
  irst presentment of the drawee for acceptance.

  General and qualified acceptance
  An acceptance is either (a) general; or (b) qualified.
  A general acceptance assents without qualification to the order
of the
  er. A qualified acceptance in express terms varies the effect of 
the
  as drawn.
  In particular, an acceptance is qualified which is--
  conditional, that is to say, which makes payment by the 
acceptor
  ndent on the fulfilment of a condition therein stated,
  partial, that is to say, an acceptance to pay part only of the 
amount
  which the bill is drawn;
  local, that is to say, an acceptance to pay only at a 
particular
  ified place; an acceptance to pay at a particular place is a 
general
  ptance, unless it expressly states that the bill is to be paid 
there
  and not elsewhere;
  qualified as to time;
  the acceptance of some one or more of the drawees, but not of all.

  Inchoate instruments
  Where a simple signature on a blank paper is delivered by the 
signer
  rder that it may be converted into a bill, it operates as a 
prima
  e authority to fill it up as a complete bill for any amount, using
the
  ature for that of the drawer, or the acceptor, or an indorser;
and, in
  manner, when a bill is wanting in any material particular, the
person
  ossession of it has a prima facie authority to fill up the omission
in
  way he thinks fit. (Amended 31 of 1981 s. 65)
  In order that any such instrument, when completed, may be 
enforceable
  nst any person who became a party thereto prior to its completion, 
it
  be filled up within a reasonable time and strictly in accordance
with
  authority given. Reasonable time for this purpose is a 
question of
  : Provided that if any such instrument after completion is 
negotiated
  holder in due course, it shall be valid and effectual 
for all
  oses in his hands, and he may enforce it as if it had been filled 
up
  in a reasonable time and strictly in accordance with the 
authority

浅析监视居住的法律缺陷及其立法完善

监视居住是公安机关、人民检察院和人民法院责令犯罪嫌疑人、被告人在诉讼过程中,未经批准不得离开住处或指定的居所,并对其行动加以监视,并保证随传随到的一种刑事强制措施。该制度设立的目的是防止犯罪嫌疑人、被告人逃避或妨碍刑事诉讼,以保证刑事诉讼的顺利进行。其手段是将犯罪嫌疑人、被告人的活动区域适当限制。它是一种强制强度界于取保候审和刑事拘留之间的强制措施。这项强制措施在打击犯罪、维护犯罪嫌疑人与被告人合法权益方面发挥了应有的作用。然而,由于立法上的不完善以及执法上的偏差,监视居住在适用中出现了一些不容忽视的问题,已在一定程度上影响和阻碍了这项措施的顺利实施,。当前,随着监视居住措施的普遍使用,如何完善监视居住制度确实值得我们关注和解决。
监视居住在立法上主要存在以下问题:
一、适用对象不统一
目前,有关监视居住适用对象的法律、法规主要有《刑事诉讼法》、最高人民法院关于执行《中华人民共和国刑事诉讼法》若干问题的解释及《公安机关办理刑事案件程序规定》,但三者对关于监视居住的适用对象却不尽相同,这势必影响法律的严肃性。
《刑事诉讼法》关于监视居住适用对象有二:(一)可能判处管制、拘役或者独立适用附加刑的;(二)可能判处有期徒刑以上刑罚,采取取保候审、监视居住不致发生社会危险性的。
最高人民法院关于执行《中华人民共和国刑事诉讼法》若干问题的解释(法释〔1998〕23号 1998年6月29日)关于监视居住的适用对象有三:(一)可能判处管制、拘役或者独立适用附加刑的;(二)可能判处有期徒刑以上刑罚,采取取保候审、监视居住不致发生社会危险的;(三)应当逮捕但患有严重疾病的,或者是正在怀孕、哺乳自己婴儿的妇女。
《公安机关办理刑事案件程序规定》(1998年5月14日第35号公安部令)关于监视居住的适用对象则有七:(一)可能判处管制、拘役或者独立适用附加刑的;(二)可能判处有期徒刑以上刑罚,采取监视居住,不致发生社会危险性的;(三)应当逮捕的犯罪嫌疑人患有严重疾病,或者是正在怀孕、哺乳自己未满一周岁的婴儿的妇女;(四)对拘留的犯罪嫌疑人,证据不符合逮捕条件的;(五)提请逮捕后,检察机关不批准逮捕,需要复议、复核的;(六)犯罪嫌疑人被羁押的案件,不能在法定期限内办结,需要继续侦查的;(七)移送起诉后,检察机关决定不起诉,需要复议、复核的。
从上述法律、司法解释、规章我们可以看出,作为法律的《刑事诉讼法》对监视居住的适用对象规定仅有二种情形,而与法律具有同等效力的司法解释增加了第三种适用对象,这也无可厚非,但《公安机关办理刑事案件程序规定》作为部门规章却把监视适用对象扩宽为
七种情形,这与《立法法》第八条第五项规定相违背,对公民政治权利的剥削,限制人身自由的强制措施和处罚只能由法律作出相应的规定。所以《公安机关办理刑事案件程序规定》关于监视居住的适用对象规定显然有不妥之处。
二、规定内容前后矛盾
其一、关于监视居住的期限问题。刑事诉讼法规定监视居住的期限最长为六个月,这六个月是指公、检、法三机关监视居住的期限总和,并不是每一个执法机关的最长期限。但目前公安部、最高检察院、最高人民法院的解释和规定,却有指每一个机关各自有权使用最长期限之嫌,这样监视居住的最长期限则为十八个月。如第七十五条:人民检察院、公安机关已对犯罪嫌疑人取保候审、监视居住,案件起诉到人民法院后,人民法院对于符合取保候审、监视居住条件的,应当依法对被告人重新办理取保候审、监视居住手续。取保候审、监视居住的期限重新计算。这样规定明显与刑事诉讼法规定监视居住的期限最长为六个月前后矛盾,这样使司法实践者陷入执法尴尬,也极易侵害犯罪嫌疑人、被告人的合法权益。
其二、关于被监视居住对象脱逃转捕的问题。最为明显的就是《公安机关办理刑事案件程序规定》的第九十四条与第九十九条的前后矛盾。第九十四条 公安机关对拘留的犯罪嫌疑人,证据不符合逮捕条件的;提请逮捕后,检察机关不批准逮捕,需要复议、复核的;移送起诉后,检察机关决定不起诉,需要复议、复核的犯罪嫌疑人可以监视居住。而第九十九条却规定被监视居住的犯罪嫌疑人在监视居住期间逃跑的公安机关应当提请批准逮捕。而目前我国刑法尚未规定在被监视居住期间脱逃的应负刑事责任,当上述三种情形的被监视居住的犯罪嫌疑人在监视居住期间逃跑的,公安机关提请逮捕的条件是什么,检察院以又凭什么批准逮捕呢?这是很明显的罗辑错误。另外,刑事诉讼法的第五十七条第二款“被监视居住的犯罪嫌疑人、被告人违反前款规定,情节严重的,予以逮捕”中“情节严重”也另人费解。
三、适用范围与取保候审没有严格区分
《刑事诉讼法》、最高人民法院关于执行《中华人民共和国刑事诉讼法》若干问题的解释及《公安机关办理刑事案件程序规定》关于监视居住的适用范围均是相同的,《刑事诉讼法》第五十一条 人民法院、人民检察院和公安机关对于有下列情形之一的犯罪嫌疑人、被告人,可以取保候审或者监视居住;最高人民法院关于执行《中华人民共和国刑事诉讼法》若干问题的解释第六十六条 被告人具有下列情形之一的,人民法院可以决定取保候审或者监视居住。由于立法没有明确固定监视居住和取保候审各自的适用范围,在实际操作中必然会出现混乱,同样的情况有的适用了取保候审,有的则适用了监视居住。然而,监视居住在强制强度、监控措施等方面均与取保候审有较大的区别,要是在同样的情况下随意选择不同的强制措施则会造成对被监视居住对象人身自由权利的侵害。在办理刑事案件中,采取何种强制措施本应与犯罪的轻重及行为人的社会危害性相适应,但正是因为立法上没有明确固定监视居住和取保候审各自的适用范围,出现办案单位在办理刑事案件中随意选择这两种不同的强制措施,往往是在犯罪嫌疑人、被告人既没有保证金,又无法提供保证人时才免为其难地使用监视居住。
四、缺乏相应保障条款
监视居住作为一种强制强度界于取保候审和刑事拘留之间的强制措施,是使犯罪嫌疑人、被告人在审前处于不被羁押状态,但人身自由受到一定限制,以保证其随传随到的强制手段,但综观现行的法律、法规、规章,却没有就如何何使用这一强制措施制定相应的条款,或者说条款过于简陋,无法保障该强制措施有效实施。具体表现在以下几个方面:一、对被监视居住的犯罪嫌疑人、被告人违反《刑事诉讼法》第五十七条;《公安机关办理刑事案件程序规定》第九十七条应当遵守的规定时,没有追究其法律责任的相关法律条款。这先天性的不足,易使被监视居住的犯罪嫌疑人、被告人在监视居住期间肆意脱逃而不受法律惩处,无疑现行法律、法规、规章则成了其规避法律的“帮凶”。二、办案机关在对被监视居住的犯罪嫌疑人、被告人违反《刑事诉讼法》第五十七条;《公安机关办理刑事案件程序规定》第九十七条应当遵守的规定时,如何采取有效措施约束相对人没有作出相应的规定,仅作了可逮捕法办的规定,但在实践中常有以上所述的情形而无法呈捕却不知如何去解决,也无法解决。当使被监视居住的犯罪嫌疑人、被告人在监视居住期间肆意脱逃时,只能感慨自己监控不力,特别是对经刑拘后因逮捕证据不足转监视居住而脱逃的流窜作案嫌疑人,根本无法开展继续侦查,就算花大力气把人重新抓回,也只限于重新监控而不能变更强制措施。基于此因,办案单位往往不愿做无用之功,到监视居住期满时写一“办案说明”解除监视居住而了事。正是由于监视居住的适用性差,导致一些办案单位不愿意使用,甚至对暴力犯罪或其他严重犯罪的犯罪嫌疑人也违反规定采用了取保候审的强制措施。三、没有对被监视居住的犯罪嫌疑人、被告人的人身权利受到侵害时如何维权的法律规定。如办案机关超期或违反违指定执行场所进行监视居住的,对被监视居住的犯罪嫌疑人、被告人可向哪个机关申诉维护自己的合法机益?违法办案人员又该负何法律责任?现行法律、法规均无具体规定。且1991年5月25日最高人民法院行政审判庭关于对公安机关采取监视居住行为不服提起诉讼法院应否受理问题的电话答复 , 已明确监视居住不属行政诉讼法受案范围所列行为,公民对此不服坚持起诉,法院应裁定不予受理。至于公安机关违反相关规定进行监视居住的,可向上级公安部门及有关单位反映。这种只能“反映”的渠道不利于保护被监视居住对象的人身自由权利。
五、关于监视居住实施的法律条文简陋,可操性差
一是关于执行场所问题:刑事诉讼法第五十七条第二款规定的“未经执行机关批准不得离开住处,无固定住处的,未经批准不得离开指定的居所”中“住处”和“居所”的外延界定到底是理解为犯罪嫌疑人、被告人所居住的“市县”,还是将其仅理解为居住的庭院或居住的房屋,因现行的法律、法规尚未作出严格规定,致使在司法实践中很难把握。若按《公安机关办理刑事案件程序规定》第九十八条对“固定住处”“居所”的定义执行的话,那监视居住则成了变相的刑事拘留。另外,对犯罪嫌疑人指定居所的问题也值得我们关注,《公安机关办理刑事案件程序规定》第九十八条有作规定,但忽视了犯罪嫌疑人通常都是流窜人员,有的被抓时已是身无分文,这样“指定”就成了“没定”,且办案单位也不大愿意把流窜的犯罪嫌疑人留在本辖区,一些办案单位索性来个“没有监视居住条件”而直接放人,这极不利于刑事案件的侦破。
二是《公安机关办理刑事案件程序规定》第九十四条第五、七项,只规定对检察院不捕、不诉需要复议、复核可对犯罪嫌疑人、被告人进行监视居住,却没有规定若检察院作出了最终决定后公安机关是否继续还是解除监视居住,致使有的办案单位对检察院认定为不构成犯罪不捕或罪行轻微不诉的,也自认为有继续侦查的必要而不及时解除监视居住,消极地等到期限届满才解除。
三是具体执行问题:1、没有就监控措施作出具体规定,对被监视居住对象进行监控的程度如何,负有执行职责的公安机关在监视居住期间,到底可以做那些具体工作,是否可以以使用一些秘密侦查手段,如监听如何使用,使用对其同住人自由权造成侵害又怎么解决等。又如监视居住对象不得会见同住人及其骋请的律师以外的人,执行机关又该如何监控?现行的法律、法规均未祥细的规定。目前《公安机关办理刑事案件程序规定》第九十六条规定“公安机关根据案情需要可以暂扣其身份证、机动车(船)驾驶证件”。我们姑且不论该规定是否有扩大解释之嫌,但在中国身份证件使用率低的情况下,扣押了身份证也难起真正的监控作用。2、执行机关的责任不明确。作出监视居住决定后,办案单位把法律文书送给执行派出所就基本完事,导致监而不审,监而不侦问题普遍存在,最多每个月只例行公事的做一份讯问笔录,对被监视居住对象的行为及表现不撑握,而派出所对被监视居住人的案情不了解,往往只限于知道本辖区有其人,由于事务繁忙而疏于监控。这样既不利于对案件的侦查,而且一旦出现脱逃或其他违规行为,就不知追究何人的责任。
六、没有对特别对象作出特别规定
当前,我国实践中出现以“双规双指”替代侦查行为的怪现象。可以说这是变相的监视居住, 其实质是非侦查机关在行使侦查机关的权力,有时甚至作为法律监督机关的检察院也参与其中,究其原因目前我国刑事诉讼法所规定的五种措施是满足不了对职务犯罪的侦查。对一些位高权重的高官进行职务犯罪的在刑事强制措施上没有作出相应的规定。在法制社会中出现这种党政行为代替司法行为的现象亟待解决。
监视居住立法完善的建议
正因为监视居住立法的滞后,导致监视居住这一强制措施适用性极差,对被监视居住犯罪嫌疑人、被告人的打击处理率低。为了正确适用这项强制措施,更好地发挥其在刑事诉讼中的作用,笔者认为必须对症下药,完善立法。
一、从立法上统一监视居住的适用对象。
为了避免监视居住对象随意扩大,保障法律的严肃性,我们应该修订《刑事诉讼法》,祥细列明监视居住的适用范围,排除立法前后矛盾的罗辑错误,并建议明确监视居住与取保候审两种强制措施的适用对象和适用条件, 不能把监视居住视为取保候审的一种特殊形式,以免在实际操作中出现同样的情况有的适用了取保候审,有的则适用了监视居住。 这样才能更好地发挥监视居住的作用。
二、在立法上规定被监视居住人在监视居住期间违规行为相应的法律责任。针对监视居住措施对犯罪嫌疑人、被告人缺乏足够的法律约束力的情况,建议参照外国的保释制度,英国《1976年保释法》规定:被保释期间,被保释人无正当理由不按时到庭,除没收保释金以外,还可以逮捕被保释人,以潜逃罪论。修订《刑法》,规定被监视居住人在监视居住期间在传讯的时候及时到案;干扰证人作证;毁灭、伪造证据或者串供等违反规定行为相应的刑事责任。增强监视居住的法律约束力,使被监视居住人自觉遵守有关的规定,变被动为主动。
三、在立法上完善实施监视居住的保障制度。
针对我国现有法律、法规关于具体实施监视居住的条款简陋,可操性差的情况,建议由公、检、法三机关联合制定《关于适用监视居住措施的若于规定》,就监视居住执行中的具体细节作出祥细的规定。一要明确规定执行单位、办案单位在监视居住期间的职责权限和相应的法律责任,在派出所内设立专职的强势执行监控组,配备专人负责监视居住、取保候审、管制、拘役、监外执行等工作。二要明确规定可使用的监控手段有哪些;三要明确界定“住处”“居所”的空间范围,特别明确规定指定居所的具体做法。
四、在立法上规定对职务犯罪嫌疑人适用特别的监视居住程序。
法律明确规定“党要在法律规定的范围内活动”,而当前的“双规双指”明显是非法制行为。针对当前侦查职务犯罪实际情况,建议改革现有监视居住措施,将其分为一般的监视居住措施和特殊的监视居住措施,对高官的职务犯罪可规定远离特定地方实行监视居住,且监视居住的期间,一般以十五天为宜。从而使“双规双指”法制化。
五、在立法上明确被监视居住人的维权事项。
联合国《公民权利和政治权利国际公约》第9条第4款规定"任何因逮捕或羁押被剥夺自由的人,有资格向法庭提起诉讼,以便法庭能不拖延地决定拘禁他是否合法以及如果拘禁不合法时命令予以释放。"根据这一规定,许多国家建立了人身保护令制度,给予被羁押者提出异议、要求举行听证的权利,并由法院最终决定是否羁押。这是我国未来刑事诉讼的发展趋势,意味着审前的羁押强制措施将受严格限制,取保候审、监视居住等非羁押的强制措施将在侦查工作中发挥更大的作用,所以,监视居住措施亟待完善。为了保障监视居住的正确实施,有学者提出要实行司法令状主义原则,即对犯罪嫌疑人、被告人采取刑事强制措施时,必须经过司法机关或者司法官员的审查与批准。这一观点笔者不敢敢苟同,因为令状主义原则的实行的前提必须是司法权的完全独立,我国现行法律制度不具有此条件,况且公、检、法三机关均有各自的办案范畴。我们应当从立法上完善被监视居住人的司法救济措施,一方面强化检察院的法律监督作用,明确检察院为监视居住的申诉受理机关,另一方应赋予被监视居住人对指定监视居所和监视方法不当提出申诉的权,同时还要明确规定办案责任人违法使用监视居住的法律责任。为监视居住的正确实施提供法律上的保障。

为了规范我市物业服务收费行为,维护当事人的合法权益,根据国家发展和改革委员会、建设部联合制定的《物业服务收费管理办法》,我们制定了《物业服务收费管理办法》实施细则,现印发给你们,请遵照执行。

《物业服务收费管理办法》实施细则

第一条 为规范本市物业服务收费行为,维护当事人的合法权益,依据《中华人民共和国价格法》、《物业管理条例》及国家发改委、建设部《物业服务收费管理办法》制定本细则。
第二条 本细则适用于本市行政区域内经工商行政管理机关登记注册、物业管理行政主管部门资质认定的物业管理企业对各类物业实施管理提供服务的收费行为。
第三条 本细则所称的物业服务收费是指物业管理企业按照服务合同的约定,对房屋及配套设施设备和相关场地进行维修、养护、管理,维护相关区域内的环境卫生和秩序,向业主所收取的费用。
第四条 政府提倡业主通过公开、公平、公正的市场竞争机制选择物业管理企业,鼓励物业管理企业开展正当的价格竞争,禁止价格欺诈,促进物业服务收费通过市场竞争形成。
第五条 市物价局会同市房产局负责全市物业服务收费的监督管理工作。
第六条 物业服务收费应当遵循合理、公开以及费用与服务水平相适应的原则。
第七条 物业服务收费包括综合管理服务费、车辆停泊服务费和特约服务费。
综合管理服务费含清扫保洁及清运;绿化养护;秩序维护;公共照明、通风、供电、给排水、电梯等共用设施设备运行、小修、养护所发生的人工、原辅材料费用等。
车辆停泊服务费:是指在指定的停车场地(含室内车库)内,为维护保养场地设备设施、相关道路及管理所发生的人工、原辅材料费用等。
特约服务费:指物业管理企业受业主委托提供的户内维修、家政服务、代收代缴服务等收取的费用。
第八条 物业服务收费根据物业类型、收费性质的不同情况分别实行政府指导价和市场调节价。
普通住宅和经济适用住房的综合管理服务费,实行政府指导价。其他类型物业服务项目均实行市场调节价。
住宅区内车辆停泊服务费实行政府指导价。
特约服务费,实行市场调节价。
第九条 综合管理服务收费实行政府指导价的,由市物价局会同市房产局根据物业管理企业的服务内容、标准和物业管理区域的设施设备等因素,制定相应的基准价格及其浮动幅度,并定期公布。具体收费标准由业主与物业管理企业根据规定的基准价格和浮动幅度在物业服务合同中约定。
实行市场调节价的物业服务收费,由业主与物业管理企业在物业服务合同中约定。
第十条 物业管理企业应当按照国家发展改革委、建设部印发的《物业服务收费明码标价规定》实行明码标价,在物业管理区域内的显著位置,将服务内容、服务标准以及收费项目、收费标准等有关情况进行公示。
第十一条 对实行政府指导价的物业管理企业应当根据《湖北省经营性服务价格管理办法》的规定,到价格主管部门办理《湖北省服务价格收费许可证》,并遵守年度审验制度。
物业管理企业在办理《湖北省服务价格收费许可证》中,应当向价格主管部门提出书面申请并提供营业执照副本、资质证书、物业服务委托合同复印件和前期物业管理服务协议复印件等相关资料。价格主管部门正式受理后,一般应在15个工作日内办理完毕。
第十二条 业主与物业管理企业可以采取包干制或者酬金制等形式约定物业服务费用。
包干制是指由业主向物业管理企业支付固定物业服务费用,盈余或者亏损均由物业管理企业享有或者承担的物业服务计费方式。
酬金制是指在预收的物业服务资金中按约定比例或者约定数额提取酬金支付给物业管理企业,其余全部用于物业服务合同约定的支出,结余或者不足均由业主享有或者承担的物业服务计费方式。
第十三条 建设单位与物业买受人签订买卖合同时,受委托的物业管理企业应与物业买受人签订前期物业管理服务协议,约定物业管理服务内容、服务标准、收费标准、计费方式及计费起始时间等内容,涉及物业买受人共同利益的约定应当一致。
第十四条 实行物业服务费用包干制的,物业服务费用的构成包括物业服务成本、法定税费和物业管理企业的利润。
实行物业服务费用酬金制的,预收的物业服务资金包括物业服务支出和物业管理企业的酬金。
物业服务成本或者物业服务支出构成一般包括以下部分:
1、管理、服务人员的工资、社会保险和按规定提取的福利费等;
2、物业公共部位、公共设施、设备日常运行维护费用;
3、物业管理区域清洁卫生费用;
4、物业管理区域绿化养护费用;
5、物业管理区域秩序维护费用;
6、办公费用;
7、物业管理企业用于该项目的固定资产折旧;
8、物业共用部位、共用设施设备及公众责任保险费用;
9、经业主同意的其它费用;
物业共用部位、共用设施设备的大修、中修和更新、改造费用,应当通过专项维修资金予以列支,不得计入物业服务支出或者物业服务成本。
第十五条 实行物业服务费用酬金制的,预收的物业服务支出属于代管性质,为所交纳的业主所有,物业管理企业不得将其用于物业服务合同约定以外的支出。
物业管理企业应当向业主大会或者全体业主公布物业管理服务资金年度预决算,并每年不少于一次公布物业服务资金的收支情况。
业主或者业主大会对公布的物业服务资金年度预决算和物业服务资金收支情况提出质询时,物业管理企业应当及时答复。
第十六条 物业服务收费采取酬金制方式,物业管理企业或者业主大会可以按照物业服务合同约定聘请专业机构对物业服务资金年度预决算和物业资金的收支情况进行审计。
第十七条 物业管理企业在物业服务中应当遵守国家的价格法律法规,严格履行物业服务合同,为业主提供质价相符的服务。
第十八条 业主按前期物业管理服务协议约定的时间开始全额交纳物业服务费;纳入物业管理范围的已竣工但尚未出售,或者因开发建设单位原因未按时交给物业买受人的物业,物业服务费用由开发建设单位全额交纳。
第十九条 物业管理企业可按月、按季度或按年度计收,但不得一次性预收一年以上(不含一年)的物业服务费。
第二十条 业主与物业使用人约定由物业使用人交纳的物业服务费用或者物业服务资金的,从其约定,业主负连带交纳责任。
物业发生产权转移时,业主或者物业使用人应当结清物业服务费用或者物业服务资金。
物业服务费用或者服务资金以房屋所有权证登记的建筑面积计算,未办证的,暂以房产测绘部门实测的房屋建筑面积计算。
第二十一条 物业管理区域内,供水、供电、供气、供热、通讯、有线电视等单位应当向最终用户收取有关费用。物业管理企业接受委托代收上述费用的,可向委托单位收取手续费,不得向业主收取手续费等额外费用。
第二十二条 利用物业共用部位、共用设施设备进行经营的,应当征得相关业主、业主大会、物业管理企业的同意后,按照规定办理有关手续。所得收益应当主要用于补充专项维修资金,也可以按照业主大会的决定使用。
第二十三条 物业管理企业已接受委托实施物业服务并相应收取服务费用的,其他部门和单位不得重复收取性质和内容相同的费用。
第二十四条 物业管理企业根据业主的委托提供服务合同约定以外的服务,服务收费由双方约定。
第二十五条 普通住宅和经济适用住房小区的露天或室内配套停车场(库)车辆停泊服务费标准按市价格主管部门会同市房产行政主管部门公布的指导价执行。
在保证业主停车的前提下,有条件的住宅区可设立外来临时停车位,对临时进入小区接送人的车辆,收费标准按市价格主管部门会同市房产行政主管部门公布的指导价执行。
第二十六条 政府价格管理部门会同房产行政主管部门,应当加强对物业管理企业的服务内容、标准和收费项目、标准的监督。物业管理企业违反价格法律、法规和规定,由政府价格主管部门依据《中华人民共和国价格法》和《价格违法行为行政处罚规定》予以处罚。
第二十七条 东西湖、汉南、江夏、蔡甸、黄陂、新洲区可依据本细则并结合当地实际情况,制定本区具体实施细则及普通住宅物业综合管理服务费和车辆泊车服务费指导价格。并报市物价局和市房产局备案。
第二十八条 本细则由市物价局会同市房产局负责解释。
第二十九条 本细则自2004年10月1日起执行。《武汉市物业管理服务收费实施办法》(武价房字200024号)同时废止。
